Savvy Butler – Terms & Conditions

1. Introduction

By using the Savvy Butler platform ("Service"), you confirm that you accept these Terms and Conditions ("Agreement") in full. If you do not agree, you must not use the Service. These terms govern your access and use of the Savvy Butler platform, operated by Glabur Holdings Ltd, a company incorporated in Cyprus.

2. Definitions

• User: A property owner, host, manager, or agent using Savvy Butler to create and share guest content.
• Guest: A person staying at a property and receiving the digital guidebook or services powered by Savvy Butler.
• Content: All materials (text, images, video, links, etc.) created or uploaded by the User to share with Guests.
• Platform: The Savvy Butler web and app environment, tools, and infrastructure.

3. Nature of Services

Savvy Butler is a software-as-a-service platform allowing Users to create and share digital guidebooks and service-related information with Guests, such as arrival instructions, transportation coordination, or local recommendations.

We offer:

• A digital web-based guidebook
• Communication tools (e.g., WhatsApp integrations)
• Optional concierge and automation features

Savvy Butler provides the infrastructure only. Users are solely responsible for the accuracy and suitability of their Content.

4. License

Savvy Butler grants the User a non-exclusive, non-transferable, revocable license to access and use the Service solely for short-term rental management purposes.

5. Fees and Payment

• Free Trial: Savvy Operations, and the plans offered before Savvy Operations, Savvy PMS and Savvy Complete, include a 15-day free trial when started through checkout, without charge. Savvy PMS and Savvy Complete have no free trial: the subscription and the first payment start when you confirm checkout, which shows the total payable that day, including VAT.
• Activation: Continued use after the trial requires account activation and payment.
• Payments: Fees are collected via third-party processors. Glabur Holdings Ltd does not store card details.
• Late Payments: Outstanding invoices will accrue interest at 5% per annum and may be escalated to recovery.

6. Termination

You may cancel at any time. Subscriptions bought through self-service checkout can be cancelled directly in Savvy Butler under Settings → Current Plan; hotel and other plans arranged with our team are cancelled by contacting us at info@savvybutler.com. Cancellation takes effect at the end of the current billing period, and your subscription remains fully active until then. No refunds will be issued for early termination. We may terminate this agreement for material breach or misuse of the platform.

Upon termination:

• Your account and Content are retained in line with our Privacy Policy, not deleted automatically.
• Users are advised to retain their own copies of their Content.
• To request deletion of your account and data, contact us at info@savvybutler.com.

7. User Responsibilities

• You are solely responsible for all Content you upload or share via the platform.
• You must ensure Content is accurate, lawful, and does not infringe third-party rights.
• You warrant that you have the Guest's consent to process their personal data when using automated services (e.g., sending SMS or WhatsApp).

You must not:

• Copy third-party content without permission
• Attempt to reverse engineer the platform
• Share login credentials or allow unauthorised access
• Use Savvy Butler to offer illegal or misleading services

You will indemnify Glabur Holdings Ltd against any loss arising from your misuse or unlawful use of the platform.

8. Data Protection & GDPR Compliance

We process data under the EU General Data Protection Regulation (GDPR).

When processing Guest data on your behalf, you are the data controller, and Savvy Butler acts as a processor. See our Privacy Policy for full details.

You confirm that:

• You have obtained proper consent from Guests before uploading their personal data.
• You agree to Savvy Butler's Data Processing Agreement (see Section 18).

9. Guest Communications

You may use the platform to send Guests links, information, or automated messages.

You confirm that:

• Guests have opted in to receive messages
• Content is appropriate, clear, and safe to use
• Glabur Holdings Ltd bears no liability for any loss, misinformation, or injury resulting from Guest reliance on the Content

10. Platform Availability

We aim to provide 99% uptime but cannot guarantee uninterrupted access. Downtime, errors, or maintenance may occur, and we accept no liability for lost revenue or service disruptions.

11. Intellectual Property

• All Savvy Butler software, design, and structure are owned by Glabur Holdings Ltd.
• You retain ownership of your own uploaded Content.
• You grant Glabur a license to host and display your Content solely for the purpose of providing the Service.

12. Confidentiality

Both parties agree to keep all sensitive business, technical, and Guest-related data confidential, even after termination.

13. Liability Disclaimer

To the extent permitted by law:

Glabur Holdings Ltd is not liable for:

• Lost profits or business interruptions
• Guest complaints due to Content or directions
• Misuse of service or third-party links

Total liability is limited to the total fees paid by you in the past 12 months.

14. Force Majeure

Neither party shall be liable for delays or failure due to events beyond their control, including but not limited to acts of God, natural disasters, war, terrorism, or internet outages.

15. Governing Law & Jurisdiction

This agreement shall be governed by and interpreted under the laws of Cyprus and the European Union. Disputes shall be subject to the exclusive jurisdiction of the Cypriot Courts.

16. Modifications to Terms

We may amend these Terms & Conditions with notice. Continued use of the platform after changes implies acceptance.

18. Data Processing Schedule (as required by GDPR)

When Glabur Holdings Ltd processes personal data on behalf of Users:

• Data Controller: You (the User)
• Data Processor: Glabur Holdings Ltd
• Data Subjects: Guests
• Types of Data: Name, email, phone number, stay dates, service preferences
• Processing Purpose: To facilitate digital guest experience and optional services
• Retention: For the duration of the User's account and up to 12 months after closure unless otherwise requested

Glabur Holdings Ltd agrees to:

• Only process data under your instruction
• Use secure processing and encryption methods
• Notify you of any data breaches
• Not transfer data outside the EEA without adequate safeguards

19. Entire Agreement

These Terms, along with our Privacy Policy and Data Processing Schedule, constitute the full agreement between you and Glabur Holdings Ltd.
